Information on the Revision of the Tobacco and Related Products Use Restriction Act

The Slovenian government recently informed the European Commission of the draft amendment to the Tobacco and Related Products Use Restriction Act, which imposes stricter requirements on electronic cigarettes and clarifies requirements for heating tobacco products, among others. Here are some of the main updates:

1. Smoke oil capacity limit: The revised bill stipulates that the liquid or refill capacity containing or not containing nicotine shall not exceed 10 milliliters. In disposable e-cigarettes or disposable refills, the capacity of the refill or oil tank shall not exceed 2 milliliters. Therefore, the volume limit requirements for electronic cigarette related products with 0 nicotine are consistent with those containing nicotine.

2. Restriction on the aroma of tobacco oil: The amendment prohibits the addition of any seasoning to tobacco or mint flavored tobacco oil that contains nicotine or does not contain nicotine. Only tobacco and mint flavors are allowed. After the bill takes effect, e-cigarette products with flavors other than tobacco and mint will have a 12 month transition period.

3. A list of permitted seasoning substances has been established, as shown in the table below:

4. Added the definition of heated tobacco products and clarified the notification requirements in accordance with the latest TPD requirements on warning signs and taste bans.

The amendment also prohibits sponsorship and advertising of tobacco products and expands the scope of smoking bans in public places.

This revision demonstrates the Slovenian government's determination to protect public health, and e-cigarette companies may need to readjust their product design and marketing strategies.
