Belgium Electronic Cigarette 2024 EU-CEG Notification Guidelines

On August 1, 2024, Belgium updated the EU-CEG notification guidelines, which were expanded in content and made some changes compared to the 2022 notification guidelines. Here are some specific requirements listed.

Product type:

ž    Disposable electronic cigarettes: sales prohibited from January 1, 2025

ž    Removable electronic cigarette (with smoke cartridge): Only one device is allowed to be paired with one pre filled smoke cartridge

ž    Removable electronic cigarette (without cartridge): device only

ž    Open electronic cigarettes (including e-liquid): Belgium prohibits the registration/sale of open devices in combination with e-liquid as it is a promotional activity

ž    Open electronic cigarettes (excluding e-liquid): device only

ž    A set containing multiple devices or supplementary containers: suitable for devices+multiple e-liquid free cartridges; If sold separately, separate notification is required

ž    Individual components of oil containing electronic cigarettes: used for replacing any electronic cigarette component (resistor, etc.) or any individual component (atomizer, etc.). It should be noted that components such as resistance wires, batteries, cotton, suction nozzles, and heat-resistant glass (such as oil tanks) do not need to be reported, but if they are reported, they will still be reviewed and require payment.

Specific requirements for product identification:

The product must clearly indicate the brand name, sub brand name, and product type

ž    For e-liquid, detailed information on taste and nicotine concentration must be included

ž    For equipment, the model name and tank capacity must be specified

Packaging requirements:

ž    The product packaging must include clear detailed information on the ingredients and be consistent with the information in the notification system.

ž    The EC-ID in the notification must be consistent with the EC-ID on the packaging

ž    The packaging needs to meet the relevant requirements of CLP regulations

ž    When conducting product notifications, it is necessary to upload the packaging and instructions of the product (only PDF and image formats are accepted)

Volume limitations of open devices

ž    Cancel the tolerance for the capacity of electronic cigarette liquid storage tanks, which means that all reported tanks or cartridges must be strictly controlled within 2 milliliters instead of 5 milliliters. Products exceeding this capacity will no longer be accepted.

ž    This regulation applies to all newly notified electronic cigarette devices and related products, and existing products that require significant modifications or re notification must also comply with this new requirement.

Prohibit the sale of the following products

Adding CBD to e-liquid

Bagged e-liquid

There are different flavors of e-liquid in the same packaging

E-liquids with different nicotine contents in the same packaging

More than 2 cartridges with the same taste and nicotine level in the same packaging

A combination of an electronic cigarette device and one or more e-liquid refills

Electronic cigarettes have attractive features, but these features have no effect on device operation

Annual Report

Require manufacturers to submit annual reports before March 1st each year and make payments within thirty days of receiving invoices; If not submitted or paid on time, the product will be included in the negative list.

Regarding fees (payment within 30 days):

ž    New notification product: € 200

ž    Substantive change: € 100

ž    Annual report: € 50

Payment process

The Belgian authorities no longer charge notification fees to third-party companies (such as agencies or other representative organizations), and all related fees will be directly charged to the applying company.
