On August 1st, the Department of Trade and Industry (DTI) of the Philippines issued Executive Order No. 25-10 (2025) to further tighten the import management of nebulized nicotine and non nicotine products, related equipment, and new tobacco products.
Key points of the new regulations
1. Must hold a PS license
-All atomized products, equipment, and new tobacco products imported into the Philippines must obtain a valid Philippine DTI Standard (PS) license.
-Products holding suspended PS licenses should be prohibited from importation.
2. Comprehensive ban on "trace imports"
-It is prohibited to evade detection and authentication on the grounds of "small quantity".
-Passengers entering the Philippines are allowed to carry electronic cigarette products for personal, product testing, or non-commercial purposes only. Carrying a total capacity of no more than 10mL (with or without nicotine). This restriction also applies to e-commerce purchases.
3. Scope of application
Regardless of the country of origin, all products entering the Philippines (including franchised economic zones, free ports, and duty-free shops) are subject to the jurisdiction of this order.
4. Effective time
Effective immediately: effective from August 1, 2025, after being published in the official gazette or national newspapers.
