Bulgaria's ban on disposable electronic cigarettes officially implemented

With the end of the Standstill Period of the EU's revision of Bulgaria on January 28, 2026, the latest amendment to Bulgaria's Tobacco, Tobacco Products and Related Products Law has officially come into effect. The following are the core policy content and operational guidelines.

1、 Key nodes in the legislative process

The bill was initially submitted for EU notification on July 25, 2025.

The original suspension period was three months, but due to the "Detailed Opinion" proposed by member states such as Italy, according to EU Directive 2015/1535, the suspension period has been extended to January 28, 2026.

After the pause period ended, the Bulgarian government officially published the amendment in the State Gazette and began full implementation.

2、 Product Definition and Classification Update

The law has expanded the scope of regulation and clearly defined new products:

Disposable electronic cigarette: refers to an electronic cigarette that is pre filled with liquid by the manufacturer and cannot be refilled or refilled, regardless of whether it contains nicotine or not.

Non tobacco products: Refers to products that deliver smoke or aerosols to the human body through breathing, do not contain tobacco, nicotine, or controlled anesthetics, and are consumed through combustion, heating, or evaporation.

• Scope of related products: Clearly including electronic cigarettes (with/without nicotine), refill containers (with/without nicotine), liquids (with/without nicotine), non tobacco smoke products, and non tobacco hookah products.

Capacity limit for nicotine free electronic cigarette products

Electronic cigarette volume ≤ 2mL

• Supplement container ≤ 10mL

3、 Requirements for Health Warning Labels

The law requires specific health warnings to be labeled on retail packaging and any outer packaging:

1. Nicotine containing products:

„Това изделие съдържа никотин, който води до силно пристрастяване. Не се препоръчва за употреба от непушачи" 。

2. Nicotine free electronic cigarettes, refill containers, and liquids:

„Това изделие крие риск за Вашето здраве" 。

3. Non tobacco products:

„Това изделие крие риск за Вашето здраве" 。

Warning requirements:

Must cover up to 30% of the maximum surface of the packaging

Printed parallel to the main text of the packaging

4、 Transitional terms and inventory management

1. Inventory sales

Products that have been produced or put on the market before the law takes effect can continue to be sold for 3 months.

Products with nicotine content exceeding 20 mg/unit are only allowed to be cleared within one month after legal announcement

2. Inventory declaration:

The operator of disposable electronic cigarettes must submit a detailed inventory list to the customs department within 7 days after the law takes effect. Within 3 months after submission, the inventory can be used for:

Export to non EU countries

 Sent to other EU member states

Complete sales clearance at retail outlets

5、 Requirements for Inventory Declaration Materials

1. Business entity information

Basic information of the enterprise: company name, headquarters address, and management address

• Identification code: Unified identification code of the responsible party (ЕいК)

• Branch information: inventory storage location or business branch address

2. Detailed product specifications

List the following data by product model classification:

• Business name: The specific brand or trade name of the product.

• Packaging/Product Description: Description of the packaging specifications or physical features of the product.

• Capacity: The liquid capacity of the consumer packaging (in milliliters/mL).

• Total quantity: The total quantity of consumer packaging (pieces/box).

3. Signing and Confirmation

• Name and position of the preparer

• Name, position, and personal signature of the person in charge

• Submission date
