Recently, we learned from the official website of the Ministry of Health of New Zealand and Newshub that the government has recently released a new policy on Electronic cigarette and smoking tobacco. The goal is to reduce the attractiveness of Electronic cigarette to young people, significantly reduce the supply of tobacco and reduce their addiction. These policies have been approved by the Cabinet. It is expected that the new regulations will be formulated in August 2023, and the disposable Electronic cigarette and reusable Electronic cigarette will have three months and six months of preparation time respectively to comply with the law.
New Electronic cigarette Policy
1. Equipment requirements: the batteries of all Electronic cigarette products can be removed or replaced, and the equipment needs to have a safety mechanism to prevent children from opening
2. Nicotine content limit: reduce the maximum nicotine content allowed in disposable Electronic cigarette
3. Packaging requirements: Vape products and their packaging will only be described using a general flavor - potentially attractive names such as "marshmallow" and "strawberry jelly donut" will be prohibited. Only universal names that accurately describe the taste, such as' berry ', can be used.
4. Limitation on the distance to open stores: New Electronic cigarette stores will be prohibited from entering near the school and the hall (within 300 meters).
New Tobacco Policy
5. The primary elements of the final standard for selecting authorized tobacco retailers are the presence of a responsible person, business location, safety, security, and training. This plan will take effect from July 1, 2024, when the number of tobacco retailers will be reduced to no more than 600.
6. Starting from April 1, 2025, only very low levels of nicotine products will be sold: concentrated cigarettes contain approximately 15-16 mg/g of nicotine, while low nicotine tobacco has a nicotine content of no more than 0.08 mg/g, greatly reducing the addiction of the product.
Proposed regulation clarifies the allowable nicotine concentration of reusable Electronic cigarette products
The Ministry of Health is seeking feedback from stakeholders on a proposed regulation to clarify the maximum allowable nicotine content in reusable Electronic cigarette products sold in New Zealand.
New Zealand regulations currently stipulate that the concentration of nicotine salts in tobacco oil should not exceed 50mg/mL. However, some companies interpret this regulation as applicable to the concentration of free nicotine in tobacco oil, rather than the concentration of nicotine salts, which is significantly higher than the allowable nicotine content of 20mg/mL. Higher levels of nicotine indicate an increased risk of addiction, including among young people who have not previously smoked. The revised regulations proposed by the Ministry of Health set the maximum allowable nicotine concentration in reusable Electronic cigarette products using nicotine salt as 28.5mg/mL. This change is only applicable to reusable Electronic cigarette products that use nicotine salt.
If approved, the regulation is expected to be formulated in August 2023.
