New Zealand 2023 Smokeless Environment and Controlled Products Amendment Regulations August News

In June 2023, the New Zealand Ministry of Health announced on its official website that the government had released new policies on e-cigarettes and tobacco consumption. On August 24th, the New Zealand Ministry of Health issued a revised bill on the smoke-free environment and regulated products law. The main revisions and transition period for e-cigarettes are as follows:

1. Changes in nicotine content requirements for tobacco oil:

For cigarette oil that only contains nicotine in the form of salt and is used in reusable electronic cigarette devices, the concentration of nicotine shall not exceed 28.5 mg/mL

For all other tobacco oils, the nicotine concentration shall not exceed 20 mg/mL

2. Product Safety Mechanism

Electronic cigarette devices must have

Child safety mechanisms to prevent electronic cigarette devices from being activated or accidentally operated by children

Removable battery

In terms of electronic cigarette devices, child safety mechanisms refer to mechanisms or combinations of mechanisms that meet the following two conditions:

Before starting the electronic cigarette device, at least 2 simultaneous or 5 consecutive operations are required

The electronic cigarette automatically deactivates the device within 10 minutes after discontinuation of use

3. Disposable electronic cigarette label

Disposable electronic cigarette devices must display the total nicotine concentration, serial number, or batch number in mg/mL on the device label

Starting from October 21, 2023, the above new product safety requirements (1-3) apply to new product notifications for disposable and reusable electronic cigarette devices; Starting from December 21, 2023, it is not allowed to sell disposable electronic cigarette products that do not meet the safety requirements of these new products; Starting from March 21, 2024, reusable electronic cigarette products that do not meet the safety requirements of these new products shall not be sold.

4. Changes in taste description:

Restriction on flavor names: Electronic cigarette product names and their packaging must only use up to two flavor names listed in the attached table to describe the actual taste of the electronic cigarette product. This restriction applies to all new e-cigarette product notifications starting from October 21, 2023, and e-cigarette products that do not meet these restrictions shall not be sold from March 21, 2024.
